With the widespread of social media networks such as “Instagram,” “Snapchat,” “Twitter,” and others to circulate news and express opinions, these electronic channels existed to serve communities and increase communication among them and they also have many advantages. However, they have a number of negatives that result from its misuse by individuals, including its use in broadcasting false news and insulting others, or incitement to spread chaos and commit crimes.
These acts are considered crimes punished by law, as Article 168 of the Penal Code states that (a penalty of imprisonment for a period not exceeding two years and a fine not exceeding two hundred dinars, or one of these two penalties shall be imposed on whoever intentionally broadcasts false news, data, rumors or propaganda to disturb public security, spread terror among people or harm the public interest).
In case of defamation and insult, Article 364 stipulates that (a penalty of imprisonment for a period not exceeding two years or a fine not exceeding two hundred dinars shall be imposed on whoever intends to harm another person, by any mean of publicity, that would make him subject to punishment. The penalty shall be imprisonment and a fine or one of these two penalties if the defamation is against a public employee while he is on duty, or if it harms honour or families’ reputation.
If the defamation occurs by way of publication in a newspaper or other publications, there shall be penalties as indicated in Article 365.
